Terms of Use

These Terms of Use govern your access to and use of Well-Bearing, including the Well-Bearing mobile applications and related website resources operated by Well-Bearing, LLC. By downloading, accessing, or using Well-Bearing, you agree to these Terms.

1. About Well-Bearing

Well-Bearing is a personal wellness and organizational application designed to help you connect everyday actions with the life you want to live. It supports priorities, goals, Momentum Items, reflections, health and wellness routines, Digital Well-Being features, medication organization, summaries, and related tools.

Well-Bearing is a self-directed planning and reflection tool. It is not a medical device, not a healthcare provider, and not a substitute for professional medical, mental-health, or clinical advice, diagnosis, or treatment.

2. Not medical advice

Content, reminders, summaries, reports, and features in Well-Bearing are for personal organization and informational purposes only. They are not medical advice. Always seek the advice of a qualified health professional with any questions you may have regarding a medical condition, medication, or treatment. Never disregard professional medical advice or delay seeking it because of something you read or see in Well-Bearing.

3. Health information

If you choose to connect supported platform health services, Well-Bearing may use permission-based health and wellness information to provide features you enable. On Apple devices, this may include Apple Health. On Android devices, this may include Health Connect. Access is optional, permission-based, and limited to categories you authorize.

You remain responsible for deciding what health information to enter, connect, or share outside the app.

4. Digital Well-Being

Well-Bearing may offer optional Digital Well-Being features that help you measure or evaluate supported screen-time or app-usage behavior for Momentum Items you configure. On Apple platforms, related functionality may use Apple Screen Time / Family Controls capabilities where available. On Android, related functionality may use optional Usage Access permission granted through Android system settings.

These platform capabilities are not identical. Well-Bearing does not claim to read Google’s private Digital Wellbeing dashboard database, and Android Digital Well-Being features depend on permissions and device support.

5. Medication features

Medication features are designed to help you organize medication names, schedules, reminders, and adherence records that you choose to enter. Medication reminders and related records are not medical advice, dosing instructions, or a guarantee that a dose was taken.

You are solely responsible for following the instructions of your clinician, pharmacist, and medication labeling.

6. Reports and summaries

Well-Bearing may generate summaries and reports based on information available in the app. Reports are user-requested tools for reflection or discussion and are not clinical assessments. You are responsible for reviewing report contents before sharing them with anyone.

7. User information and permissions

You choose which features to use, what information to enter, and which optional system permissions to grant. Platform permissions (such as Apple Health, Health Connect, notifications, Screen Time-related services, or Usage Access) are controlled through the applicable operating-system settings and may be revoked by you.

Our collection and use of personal information is described in the Privacy Policy.

8. Subscriptions and trial

Well-Bearing does not offer a permanent free tier. Eligible users may receive a 14-day free trial. After the trial, continued use of paid features requires an active monthly or annual subscription.

During the trial, access to certain features is limited. Current trial limitations include Reports, Data Export, and Historical Trends. Paid subscription access unlocks the corresponding paid feature set.

Subscription offerings, prices, currencies, taxes, and billing details are presented by the Apple App Store or Google Play at the time of purchase. The marketplace price and terms shown there control the transaction. Displayed prices in marketing or in-app copy may be illustrative and can change.

9. Automatic renewal, management, and cancellation

Subscriptions renew automatically unless canceled according to the applicable App Store or Google Play rules. You can manage or cancel a subscription through your Apple ID or Google Play account subscription settings.

Deleting the Well-Bearing app does not cancel a subscription. Canceling a subscription does not automatically delete locally stored Well-Bearing data on your device.

10. Payments and refunds

Marketplace payments are processed by Apple or Google, not by Well-Bearing directly. Well-Bearing does not receive your complete payment-card details from App Store or Google Play purchases. Refund requests are handled under Apple’s or Google’s applicable refund policies and processes.

11. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Well-Bearing. If you are under the age of legal majority where you live, you may use Well-Bearing only with the involvement of a parent or legal guardian as required by applicable law.

Well-Bearing, including its name, branding, design, software, and related materials, is owned by Well-Bearing, LLC or its licensors and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of that intellectual property to you. You retain ownership of the content you create and enter into the app.

14. Third-party and platform services

Well-Bearing relies on third-party and platform services, including Apple, Google, App Store billing, Google Play billing, device operating-system services, notifications, HealthKit / Apple Health, Health Connect, Screen Time-related services, and Usage Access where applicable. Those services are governed by their own terms and privacy policies. Well-Bearing is not responsible for third-party services outside its reasonable control.

15. Availability and updates

We may update, modify, suspend, or discontinue features of Well-Bearing from time to time. We do not guarantee uninterrupted availability. Continued use after an update constitutes acceptance of the updated app experience, subject to these Terms and the Privacy Policy.

16. Disclaimer of warranties

Well-Bearing is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Well-Bearing, LLC disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed.

17. Limitation of liability

To the fullest extent permitted by law, Well-Bearing, LLC and its officers, members, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of Well-Bearing.

To the fullest extent permitted by law, Well-Bearing, LLC’s total liability for any claim arising out of or relating to these Terms or Well-Bearing will not exceed the greater of (a) the amount you paid to Well-Bearing for Well-Bearing subscriptions in the 12 months before the claim or (b) fifty U.S. dollars (US $50). Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the maximum extent permitted by law.

18. Termination

You may stop using Well-Bearing at any time. We may suspend or terminate access if you violate these Terms or if required for legal, security, or operational reasons. Provisions that by their nature should survive termination will survive.

19. Changes to these Terms

We may update these Terms from time to time. When material changes are made, the updated Terms will be posted at this page and the effective date will be revised. Continued use of Well-Bearing after the updated Terms become effective constitutes acceptance of the changes, except where applicable law requires otherwise.

20. Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles, except where applicable law in your place of residence requires otherwise. These Terms do not include a mandatory arbitration clause or a class-action waiver.

21. Apple App Store and Google Play terms

If you obtained Well-Bearing through the Apple App Store or Google Play, you acknowledge that the marketplace provider is a third-party distribution platform. Marketplace-specific terms, refund rules, and subscription-management procedures of Apple or Google also apply to purchases made through those stores. To the extent required by Apple’s standard licensed-application end-user terms, Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms with respect to your use of the iOS app, and Apple has the right to enforce those terms against you as a third-party beneficiary.
